The use of the Future Zen website is governed by the terms and agreement set forth below. Please read them carefully. Your use of the website indicate acceptance of these terms and conditions. Future Zen reserves the right to make changes to this website and these terms and conditions at any time without any prior notice. Future Zen is a service provider to the website and is also referred to as 'us', 'vendor', 'we'. The customer is the individual or organisation who is using the website and its services, and is also referred to 'you', 'customers'

All brands and names are trademarks of their respective companies.

Terms of Sale

1. COMPATIBILITY

  1. Compatibility between all hardware or software products is not guaranteed. It is the customers responsibility to ensure compatibility issues between all hardware and software to be resolved prior to ordering.
  2. Future Zen has limited information regarding compatibility and will try to assist customers when possible, however customers are encouraged to do their own research and trials first.
  3. It is generally recommended to test with a trial version or request a trial license of software prior to purchasing.

2. REFUNDS, CANCELLATIONS AND WARRANTY

  1. Customers must contact Future Zen via email or the support form on our website to request for refunds, cancellations or warranty claims.
  2. Cancellation of periodic subscriptions or services such as a monthly support plan must be received in writing (an email will suffice). Cancellation will be effective at the end of the period which has been paid up to.
  3. License orders may only be cancelled for a full refund prior to delivery of the license(s). Once a license has been delivered, a refund must be requested.
  4. Refunds will be granted at our discretion, in accordance with Australian Consumer Law.
  5. In addition to warranties enforced under Australian Consumer Law, Future Zen will honour the advertised warranties on products sold on this website at the time of purchase.
  6. Future Zen will NOT be liable in any way for incidental, consequential or indirect loss resulting from faulty products. Future Zen is not responsible for any data loss; backing up of data is the responsibility of the customer.

3.  PRICING

  1. All prices quoted on the website are inclusive of GST, but does not include delivery, and is based on payment by credit card.
  2. All products advertised do not include the cost for any installation or troubleshooting compatibility issues. If you require assistance on installation/troubleshooting, see our support page.
  3. All prices are subject to change without notice. By placing the order, the customer has agreed to pay the prices as listed on the checkout page at the time the order was originally submitted.

4. SALES TAX

  1. All of our advertised prices are already inclusive of GST. We do not sell at ex-GST prices to any individuals or businesses.
  2. We are registered to collect GST on behalf of ATO, our ABN is 42 104 997 462. GST components (10% Goods and Services Tax) are shown against each item on our invoices.
  3. You are not required to provide us with your ABN number when purchasing products from us unless you are a Government, Education or Corporate customer.

5. COPYRIGHT AND TRADEMARKS

  1. Future Zen owns the copyright and trademarks to all our intellectual property which includes the name Future Zen, its website and logo. Any person/business entity using it without our prior written consent will be deemed in breach of the copyright law and will result in legal action.
  2. Manufacturer's images, trademarks and links used within our websites are reserved copyrights and trademarks of their respective owners.

6. LICENSE AGREEMENTS

  1. By purchasing from the Future Zen website, the Customer agrees to abide by any and all software license agreements associated with the products purchased.

7. PAYMENTS

  1. We accept credit card payments via our online store which are processed through Stripe.
  2. Credit card payments will not be accepted over the phone or sent via email.
  3. We also accept payments made via PayPal.
  4. Periodic subscriptions such as monthly support plans will be automatically charged to the credit card or PayPal account used at checkout when then product was purchased.
  5. We reserve the right to refuse a payment if it is suspected to be fraudulent.

 8. GOVERNING LAW

  1. The Customer agrees to abide by all local, state and federal laws pursuant to the products or services delivered by Future Zen.
  2. The Customer agrees that these and all Futurezen Terms, Policies and Agreements are governed by the laws of Victoria, Australia, and agrees to the exclusive jurisdiction of the Courts of that state.

9. CHANGES

  1. Future Zen may amend these Terms of Sale at any time. Changes to this agreement will become effective upon their publication to our website.
